TERMS OF DELIVERY

TERMS OF DELIVERY SUBSCRIPTIONS AND SINGLE EDITIONS


1.1 These terms and conditions of delivery apply to all subscription agreements relating to:

  1. a) magazines published by TPK Media & Events B.V., Heidestraat 149, 6114 AC Susteren, Chamber of Commerce number: 59599081 in Limburg Zuid VAT number: NL853562672B01, hereinafter also referred to as “TPK”;
  2. b) digital services of TPK

1.2 A subscription includes either the delivery of a magazine published by TPK for the agreed term or a single edition, or the delivery of a digital service offered by TPK for the agreed term.

1.3 The subscriber is deemed to accept these terms and conditions by entering into a subscription provided by TPK.

1.4 TPK guarantees that the delivered subscription complies with the agreement and meets the specifications stated in the offer.

1.5 Deviations from the provisions in these general terms and conditions are only permitted if expressly agreed in writing; in that case, the other provisions of these general terms and conditions will remain in full force.

1.6 The subscriber must be at least 18 years old.

1.7 TPK is entitled to discontinue the publication of the magazine or the digital service for which the subscription has been taken out at any time, for any reason whatsoever. In that case, after discontinuation, it is not obliged to perform any further delivery. In that case, the subscriber is entitled to a partial refund of the prepaid subscription fee.

1.8 These TPK delivery conditions are available free of charge upon request from:

1.9 TPK reserves the right to make changes to these general terms and conditions. Therefore, check these conditions regularly.

 

New subscriptions
2.1 New subscriptions can commence at any time.

Right of withdrawal
3.1 The subscriber has the option to withdraw from the agreement without stating reasons within 14 days of receiving the first magazine under the subscription (the withdrawal period).

3.2 The subscriber can exercise the right of withdrawal by contacting TPK's customer service (see contact details above under 1.8) within the period mentioned under 3.1 and indicating that the subscriber wishes to exercise their right of withdrawal. If the subscriber proceeds to withdraw from the agreement, they will receive a confirmation by email or post.

3.3 If the subscriber wishes to exercise their right of withdrawal, they must also return the magazines already received to TPK & Events B.V., Heidestraat 149, 6114 AC Susteren, or hand them over, within 14 days of the day on which the withdrawal is invoked. The costs for the return shipment are borne by the subscriber and are estimated at a maximum amount of € 8 (in the case of postal or parcel delivery by PostNL).

3.4 In the event that the subscriber exercises their right of withdrawal, they will receive the purchase amount already paid back within 14 days, whereby we reserve the right to wait with reimbursement until the moment we have received the goods back, or have received proof of return shipment of the goods.

3.5 In the case of a subscription to digital services from TPK, the subscriber has no right of withdrawal.

 

Duration and termination of the subscription
4.1 A subscription is entered into for the specified period and is then – subject to cancellation – automatically renewed for a period of one year, unless otherwise stated in the offer. The subscription can only be terminated at the end of the agreed subscription term, whereby the subscriber must notify TPK of the cancellation no later than one month before the expiry of the subscription term. This can be done in writing, by email or via the contact form on the customer service page.

4.2 Information about the duration of your subscription can be obtained from TPK's customer service by post, telephone, e-mail and via the contact form on the customer service page. The contact details are also listed in the imprint of the magazine or the website (in the case of a digital service).

 

Payment of subscription fee and method of payment
5.1 In the case of a magazine subscription, payment of the subscription fee must be made prior to the subscription period in a manner accepted by the subscriber when entering into the subscription (iDeal, Sofort, credit card, bancontact). When paying by credit card, the amount will be debited directly from the card specified by the subscriber. The payment terms that apply to renewal of the subscription can be found in the imprint or service page of the magazine. The subscription prices can also be found in the imprint or on the service page of the magazine. Or, in the case of a digital service, on the relevant website. Payment of the subscription fee must be made prior to the subscription period; the subscriber will receive an invoice for the payment of the subscription fee upon renewal.

5.2 In the event of late payment, including due to reversal of direct debits or an insufficient balance on the specified account, reminder fees will be charged. If payment for the subscription has not been received even after a reminder, TPK is entitled to unilaterally terminate the subscription with immediate effect and to claim any compensation and outstanding payments.

5.3 All subscription prices are in euros and exclusive of VAT.

5.4 TPK reserves the right to change the subscription price during the term of the subscription. A change in the subscription price will be published no later than four weeks before it takes effect, in the case of a magazine subscription in the colophon of the relevant magazine and in the case of a subscription to a digital service via the website that offers the relevant digital service.

 

Delivery
6.1 The delivery of TPK magazines in the Netherlands takes place via post.nl. If the magazine has not arrived or has arrived damaged, the subscriber can contact customer service, see the customer service page for more information.

6.2 In order to guarantee the uninterrupted continuation of delivery, address changes must be submitted no later than three weeks before the moving date by email or post or via the contact form on the customer service page.

Privacy and the Personal Data Protection Act
7.1 TPK is responsible for processing customer data collected when entering into new subscriptions, including for the purpose of:
i) being able to execute the agreement between TPK and the subscriber;
ii) maintaining a record of all subscribers;
iii) making relevant offers from TPK; and
iv) making relevant offers from carefully selected third parties (advertisers).

7.2 TPK respects the privacy of its subscribers.

7.3 The subscriber acknowledges having been informed of the collection and provision of his personal data and the use that can be made of it, and the subscriber agrees to the privacy and cookie policy of TPK.

Complaints
8.1 The subscriber must report complaints to TPK as soon as possible after they arise, via the contact details stated in article 1.8 of these terms and conditions. TPK will handle the complaint and send a message to the subscriber no later than two weeks. If no solution is reached, the subscriber can use the ODR platform (Online Dispute Resolution) of the European Commission via http://ec.europa.eu/consumers/odr for the extrajudicial settlement of a dispute.

 

Liability
9.1 TPK is only liable for damage suffered by the subscriber if this damage is attributable to TPK or if it is at TPK's risk pursuant to legal provisions.

9.2 TPK is not liable for damage resulting from the use by the subscriber of any service or article supplied by TPK, unless TPK is liable under the provisions regarding product liability as referred to in Section 6:185 et seq. of the Dutch Civil Code.

9.3 TPK is not liable for any damage if this is caused by a shortcoming that is the result of force majeure. Force majeure exists if the shortcoming is the result of circumstances beyond TPK's control, which in any case includes: war or similar situations, riot, sabotage, boycott, strike, occupation, blockade, illness of TPK personnel, failure of TPK's suppliers and/or transporters, government measures (including a foreign government) such as a transport, import, or production ban, natural disasters, bad weather, lightning strike, fire, explosion, and leakage of hazardous substances or gases. Nothing of the above applies in the event of intent and/or gross negligence on the part of TPK.

9.4 Subscriber must prove that there is intent or gross negligence on the part of TPK.

9.5 The subscriber is not permitted to set off any alleged claim for damages against any amount that the subscriber owes to TPK.

9.6 The subscription conditions, including subscription prices, are subject to manifest printing and typesetting errors.


Other provisions
10.1 Dutch law applies exclusively to these General Terms and Conditions. If a provision of these general terms and conditions proves to be invalid, the other provisions will remain in full force. The invalid provision will then be replaced by a valid provision that corresponds as closely as possible to the intention of the invalid provision.

10.2 These General Terms and Conditions come into effect on 01-09-2022. As of that date, previously published Delivery Conditions expire.
